In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Diver Dan's Inc. shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price. Diver Dan's Inc. shall have the right to cancel or refuse any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has been charged, Diver Dan's will immediately issue a credit to your credit card account in the amount of the charge.

Your receipt of an electronic order or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Diver Dan's reserves the right at any time after receipt of your order to accept or decline your order for any reason. Diver Dan's reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item.

All orders placed over $2,000.00 ( US) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order. Diver Dan's is a reseller to end user customers and does not accept orders from scuba dealers, exporters, wholesalers, or other customers who intend to resell the products offered by Diver Dan's.

Diver Dan's will automatically charge and withhold the applicable sales tax for orders to be delivered to addresses in California. Each customer in other states shall be responsible for all sales taxes, or other taxes, on orders shipped in other states.

Under no circumstances, including, but not limited to, negligence, shall Diver Dan's be liable for any direct, indirect, special, incidental or consequential damages, including but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site. You agree that the sole and exclusive maximum liability to Diver Dan's arising from any product sold on the Diver Dan's site shall be the price of the product order. You agree that in no event shall Diver Dan's directors, officers, employees or other respresentatives be liable for special, indirect, consequential or punitive damages related to product sold.

Any sales by Diver Dan's shall be governed by the laws of the State of California, without regard to Conflict of Laws rules. The customer consents to the Jurisdiction of the Federal or State courts located in California for purposes of any suit, action or preceding arising out of any sale.

Title to goods herein being purchased passes to the purchaser upon delivery of the goods to the purchaser, unless otherwise specified. Loss or damage that occurs during shipping by a carrier selected by Diver Dan's is Diver Dan's responsibility. Loss or damage that occurs during shipping by a carrier selected by the Customer is Customer’s responsibility.

Diver Dan's hereby expressly disclaims all warranties either expressed or implied, including, without limitation, any warranty of merchantability or fitness for a particular purpose. This disclaimer by Diver Dan's in no way affects the terms of the manufacturer’s warranty, if any.

For all prices, products and offers, Diver Dan's reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances While Diver Dan's uses all efforts to include accurate and up to date information on the site, Diver Dan's makes no warranties or representations as to the Site’s accuracy. Diver Dan's assumes no liability or responsibility for any errors or omissions in the content on the site.
